General Terms and Conditions (GTC)

§ 1 Scope and Contractual Partners

The contracting party is Oleksandr Makovetskyi, trading as Renthelfer, Kleeblatt 64, 42119 Wuppertal, Germany. These GTC apply to all services provided by Renthelfer to users of the platform renthelfer.de. By registering, you fully accept these GTC. Deviating conditions of the user do not apply.

§ 2 Conclusion of Contract

The contract is concluded through complete registration (entry of email address, password, role selection, and confirmation of the GTC) and subsequent account activation. When using Google/Facebook login, the contract is concluded with the first successful login.

§ 3 Scope of Services

Renthelfer offers AI-supported tools for rental communication: letter generation, document analysis, utility cost review, rent increase check, rent reduction calculator, rent price comparison, location and site analyses, deadline tracker, rental file, handover protocol, CV and cover letters, Jobcenter help, and AI Assistant. All generated texts and analyses are drafts and formulation aids and do not replace legal advice. We cannot guarantee the accuracy of their content (see Liability).

§ 4 Subscription, Prices, and Payment

Renthelfer offers free and paid subscriptions. Prices are listed on the pricing page (no VAT is charged under § 19 UStG). Payment is made monthly or annually in advance via Stripe. The subscription automatically renews unless canceled before the end of the billing period. Price changes for existing subscriptions apply only if the user expressly agrees to them after being informed in text form (see "Changes to the Terms"); otherwise the subscription continues on the previous terms. Individual services can be unlocked or booked on a one-off basis (e.g. reports as well as paper letter and registered mail dispatch via Pingen and Deutsche Post); the prices and notices shown before purchase apply. We cannot guarantee a specific delivery time for delivery by third parties.

§ 5 Termination and Contract Termination

Paid subscriptions can be canceled at any time at the end of the current billing period. After cancellation, access remains until the end of the paid period; thereafter, it automatically switches to the free plan. The account can be permanently deleted at any time (Profile → "Delete Account"); all data will be removed in accordance with the privacy policy.

§ 6 Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason (§ 355 BGB). The withdrawal period begins with the conclusion of the contract. If you expressly request that the service begins before the withdrawal period expires and you are aware of your right of withdrawal, the right of withdrawal expires upon full performance of the contract. § 7 Liability

Renthelfer is liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, Renthelfer is liable only for breach of essential contractual obligations (cardinal duties), limited to the foreseeable damage typical for this type of contract; otherwise, liability for slight negligence is excluded. Statutory rights in respect of defects in a service acquired for payment remain unaffected. The accuracy of AI-generated texts cannot be guaranteed; they are drafts that the user must check before use.

§ 8 User Obligations

Users are obliged to: (1) not provide false information during registration; (2) keep access data confidential; (3) not use the service for illegal purposes; (4) not perform automated queries or scraping; (5) not upload content to which third parties have rights without appropriate authorization. Violations may lead to immediate account suspension.

§ 9 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy.

§ 10 Changes to the GTC

We may amend these Terms and Conditions for the future if there is a valid reason for doing so (e.g. new functions or changes in the law). Amendments that affect the scope of services, the prices or the balance between performance and consideration to the user's disadvantage only become effective if the user expressly consents to them; we actively seek this consent (e.g. by means of a confirmation link or button) and point out the amendment in doing so. If the user does not consent, the contract continues on the previous terms. Purely editorial corrections that do not change rights and obligations (e.g. typing errors or a new address) do not require consent. Silence never constitutes consent.

§ 11 Multi-User / Team Accounts

The Business plan is currently not available for purchase. Once it is offered, the following applies: For business customers, Renthelfer offers the option to add further users to their own account via an invitation feature (a "team account"). The inviting account holder warrants that they are authorised to invite the respective person and is liable for that person's actions when using Renthelfer as if they were their own. Invited employees register with their own email address and password and accept these Terms independently. An employee's access to the team account ends automatically upon termination of the contract between Renthelfer and the account holder, and at any time if the account holder revokes the seat; the employee's personal access to Renthelfer as a separate, free account is unaffected. Content of the team account that is used jointly (properties, maintenance entries, deposits, text blocks, company name and logo) is assigned to the account holder and stays with them. Letters and cases that an employee creates themselves are kept in that employee's personal account; the account holder sees them in the team overview and reviews letters before approval. When an employee leaves, they lose access to the jointly used content; the letters they created themselves remain in their account.

§ 12 Real Estate Marketplace (Listings)

For the "Real Estate" section, the following additional conditions apply. They take precedence over the other provisions of these Terms and Conditions in the event of a conflict, insofar as they concern listings.

Role of Renthelfer. Renthelfer solely provides the technical platform and stores the listings posted by users. Renthelfer does not become a party to the rental or brokerage contract, does not act as a broker, and does not charge a commission. Listings are not reviewed for content before publication. The user posting the listing is solely responsible for its accuracy, completeness, and legality.

Duties of the Advertiser. Anyone posting a listing assures that they are authorized to rent out the property and will provide only truthful information. In particular, the mandatory information according to § 87 GModG (type of energy certificate, final energy demand or consumption, main energy source, year of construction, and energy efficiency class) must be provided in full, if an energy certificate is available. A violation can be punished as an administrative offense with a fine according to § 108 GModG; the advertiser bears the responsibility for this. Photos and texts may only be posted if the user possesses the necessary usage rights.

Prohibited Content. Prohibited are, in particular: listings for non-existent or unavailable properties; requests for payments before viewing and contract conclusion; information that violates the General Equal Treatment Act (AGG), such as exclusions based on origin, religion, gender, disability, age, or sexual identity; and the use of the contact function for advertising. Properties that have already been rented must be deactivated immediately.

Reports and Removal. Any registered user can report a listing using the "Report Listing" function. After three independent reports, a listing is automatically temporarily hidden and manually reviewed; the advertiser is notified of this with the reason and can revise and republish the listing. Renthelfer reserves the right to remove listings that violate these Terms and Conditions or applicable law and to suspend the affected account.

Contact Point. Reports of illegal content according to Art. 16 of Regulation (EU) 2022/2065 (Digital Services Act) can also be directed to legal@renthelfer.de in addition to the reporting function. The language of communication is German.

§ 13 Final Provisions

German law applies, excluding the UN Sales Convention. The place of jurisdiction for disputes with merchants and legal entities is Wuppertal. For consumers, the statutory place of jurisdiction applies. Should individual provisions be invalid, the remainder of the contract remains effective. Individual amendments to the contract and verbal side agreements require text form (§ 126b BGB, e.g. email) and are only valid if expressly confirmed by Renthelfer; this also applies to any change to this text-form clause itself.
